After five years of marriage, Tom Cruise and Katie Holmes are heading for divorce court.

“This is a personal and private matter for Katie and her family,” Holmes’ attorney Jonathan Wolfe, said Friday, confirming the TomKat split.

“Katie’s primary concern remains, as it always has been, her daughter’s best interest.”

TMZ reports that it was Holmes who filed for divorce and says Cruise was “blindsided” by Katie’s legal maneuver. The divorce papers were filed in NYC June 28, citing “irreconcilable differences.” Katie is seeking sole legal custody and “primary residential custody” of the pair’s 6-year-old daughter, Suri.
